Privacy Policy

Your privacy is important to esvyda Inc (“esvyda”). Our confidentiality policy has been drafted in order to explain with total transparency how we process your personal data. So we’ve developed a privacy policy that covers how we collect, use, disclose, and store your information. You may be asked to provide information anytime you are in contact with esvyda. This information may be personal information, which is data in a form that can be used to identify or contact a single person or company (“Personal Information”). We may also collect non-personal information, which is data in a form that does not allow for direct association with a specific individual (“Non-Personal Information”). Please read the following policy to understand how your information will be treated. We may from time to time amend this Privacy Policy. We post the effective date of our Privacy Policy on our website. If we make material changes to this policy we will post the revised policy and the revised effective date on this website. What information is collected from you?

Personal Information

esvyda collects Personal Information in several ways. In general, you can visit our websites or speak with a esvyda representative without telling us who you are or revealing any Personal Information about yourself. If you choose to provide your Personal Information to us, you explicitly agree to our collection and use of such information as described in this Privacy Policy.

Enrolling in esvyda Services: If you choose to enroll in our service, esvyda asks for certain Personal Information, including but not limited to your name, address, e-mail, password, zip code, phone number, credit card number, mailing address, gender, age, weight, height, photograph, and government-issued identification number as well as certain health-related information such as your health care plan, delivery hospital, and doctor or midwife, well-being related information (including without limitation blood pressure, weight, SPO2, ECG, blood glucose monitor readings and other sensitive medical information), type of medical devices you use, browser information, daily routine, and medical history.

Once you enroll, you are no longer anonymous to esvyda. You are given a esvyda identification number and are able to take full advantage of esvyda offerings. When you enroll you will also be asked to set some security questions to access your account online, and you will be required to provide the answer for authentication purposes when you log in to your account, either using the web browser or the mobile app.

Information Requests: You may request information about clinical trials without enrolling. You will be asked to provide your name, address, email, phone number, and medical condition in which you are interested. You can also request information from esvyda; we may ask for your contact information and other information that will help us assist you. Some information is required while other information may be submitted at your option.

Special Events, Promotions, Surveys and Communications: In addition, we may collect your Personal Information at other times, including, but not limited to, when you answer a voluntary survey, when you enter a voluntary sweepstakes, contest or promotion sponsored by esvyda, and when you report a problem with one of our sites or services. If you contact esvyda, we may keep a record of that correspondence.

References: When you refer a friend or family member, esvyda may collect the information you provide about that person such as his name, mailing address, email address, and phone number.

Non-Personal Information

esvyda also collects information that does not personally identify you when you access our services, visit our website, or use our mobile app. We may automatically receive and record information from your computer, mobile device, or other device you use to access our services, on our server logs. This information includes, but is not limited to, your IP address, cookie information, geolocation information, unique device identifiers, browser type, browser language, other transaction information, and the page you have requested (collectively referred to as “Site Usage Information”). Site Usage Information is aggregated to measure certain traffic patterns on our websites, such as the number of visits, average time spent on the website, pages viewed, and so on. If we do combine Non-Personal Information with Personal Information, the combined information will be treated as Personal Information as long as it remains combined.

If you are an esvyda user of the mobile app or any gateway connected to our service, to upload medical data to the system, you understand and acknowledge that when you use your medical devices in connection with our service, readings from your medical devices will be automatically uploaded to your account with us. These automatically collected readings are considered Personal Information for the purposes of this Privacy Policy.

When you receive emails from us, we may place a one-pixel gif in the email to determine whether or not readers viewed the email, if your computer or cellular phone supports this technology. This process does not leave any information on your computer, nor does it collect information from your computer or device. If you don’t want to receive emails from us you can uncheck the options available in your account and/or contact us at Please keep in mind that certain emails regarding your account status will remain being sent to your email, unless you cancel your account. What are cookies and how are they used?

esvyda website, online services, email messages, and advertisements may use cookies (“Cookies”). These technologies help us better understand user behavior, tell us which parts of our website people have visited, and facilitate and measure the effectiveness of advertisements and web searches. A Cookie is a small amount of data that is sent to your browser from a Web server and stored on your computer’s hard drive. All areas on esvyda’s website where you are prompted to log-in or that are customizable require that you accept Cookies. Cookies esvyda places will remain in place after you leave our website. You can delete cookies by following the instructions in your web browser, or decline our Cookies if your browser permits, but this may result in certain features or services not being available to you. 

Generally, we use Cookies to remind us of whom you are and to access your account information in order to deliver to you a better and more personalized service. A Cookie is set when you register or “Sign In” and is modified when you “Sign Out” of our services. esvyda also uses Cookies to store your zip code for demographic and marketing purposes, to measure Site Usage Information and to identify websites you have visited and your visiting patterns in the aggregate.

We treat information collected by Cookies as Non-Personal Information. However, to the extent that Non-Personal Information is combined with Personal Information, we treat the combined information as Personal Information for the purposes of this Privacy Policy.

We do not use technology that responds to a “do-not-track” signal from your web browser.

How is your information used?

The use of your information is subject to the Privacy Policy in effect at the time of use. 

Providing the Services You Request: We may use your Personal Information internally for our general business purposes, such as providing the services you request, responding to your inquiries, and offering you our own, our affiliates’ or third-party products and services that we think you may find of interest.

If you sign up to receive alerts to track your health, we will use the email address and/or mobile cell phone number you select/provide when signing up to track your medical devices for the sole purpose of providing you with tracking information about your medical devices or for sending medical alerts.

Improving and Developing our Services: We also use Personal Information to help us develop, deliver and improve our products, services, content, and advertising. We may also use Personal Information for internal purposes such as auditing, data analysis, and research to improve esvyda’s products, services, and customer communications.

Providing Notices: We may use your Personal Information to provide notices to you and to keep you updated on esvyda’s latest announcements and services. From time to time, we may need to use your Personal Information to send important notices, such as communications about your account. Because this information is important to your interaction with esvyda, you may not opt out of receiving these communications. Non-Personal Information: We may collect, use, transfer and disclose Non-Personal Information for any purpose.

Relevant Advertising: We may use demographic and preference information to allow advertisers to target their advertisements on our services to the users for whom they are most pertinent. This means users see advertising that is most likely to interest them, and advertisers send their messages to people who are most likely to be receptive, improving both the viewer’s experience and the effectiveness of the ads. Except as otherwise specified in this Privacy Policy, we disclose information to third parties in aggregate or non-personally-identifiable form.

Who is collecting your information?

When you are on a esvyda Website, using the esvyda mobile app, or are speaking to a esvyda representative and are asked for Personal Information, you are sharing that information with esvyda alone, unless it is specifically stated otherwise. If data is being collected by any company other than esvyda, you will be notified prior to the time of the data collection through our Privacy Policy or otherwise. If you do not want your data to be collected by any company other than esvyda, you can choose to not use that particular service.Please be aware that esvyda advertisers or websites that have links on or to our site may collect personally identifiable information about you when you visit their websites and/or purchase or use their products or services. Similarly, some of the services and advertisements included in our services are delivered or served by third-party companies that may place or recognize Cookies, Web beacons, or other technology to track certain Non-Personal Information about esvyda’s users. For example, in the course of serving certain advertisements, some advertisers may place or recognize a unique cookie on your browser in order to collect certain information about your use of the esvyda services. The information practices of those third parties are not covered by this Privacy Policy, and we do not have access to, nor control over, advertisers’ or service providers’ use of Cookies or other tracking technologies or how they may be used. 

With whom may your information be shared?

esvyda and its affiliates may share your Personal Information with each other and use it in ways that are consistent with this Privacy Policy. 

We will not sell, rent, swap, or authorize any third party to use your Personal Information without your permission, unless otherwise specified in this Privacy Policy.

Healthcare providers: If you provide your healthcare provider’s information to us we may disclose personally identifiable information you have provided us to that provider, pursuant to the Health Insurance Portability and Accountability Act (“HIPAA”) privacy rules.

Service providers: We may disclose Personal Information about you to companies who provide services to esvyda, such as information processing, extending credit, delivering products to you, managing and enhancing customer data, , providing customer service, processing orders, fulfilling orders and requests, and conducting customer research. Your Personal Information will not be shared with third parties for their marketing purposes. We provide these companies only with the information they need to perform their services for esvyda and unless we tell you differently, these companies do not have any right to use the Personal Information we share with them beyond what is necessary to perform their services for us.

Advertisers: We may allow advertisers to choose the demographic information of users who will see their advertisements. Except as otherwise specified in this Privacy Policy, we disclosure information that we have collected from you to an advertiser in non-personally-identifiable forms, in order to allow the advertiser to select the appropriate audience for its advertisements.

Others: We may disclose personally identifiable information about you if you request or authorize it. In addition, it may be necessary under law, legal process, litigation, and/or requests from public and governmental authorities, for esvyda to disclose your Personal Information. We may also disclose information about you if we determine that for purposes of national security, law enforcement, or other issues of public importance, disclosure is necessary or appropriate. We may also disclose information about you if we determine that disclosure is reasonably necessary to: (1) enforce our terms and conditions; (2) protect against misuse or unauthorized use of esvyda services; (3) protect our operations, property, and rights; and (4) protect the personal safety or property of our users or the public (among other things, this means that if you provide false information or attempt to pose as someone else, information about you may be disclosed as part of an investigation into your actions).

Additionally, in the event of a reorganization, merger, or sale we may transfer any and all Personal Information we collect to the relevant third party as part of the transferred assets. You acknowledge that such transfers may occur, and that any acquirer of esvyda or its assets may continue to use your information as forth in this Privacy Policy.

With Your Consent: Except as set forth above, you will be notified when your Personal Information or your Personal Health Information may be shared with third parties, and you will be able to prevent the sharing of this information.

We are limited by the HIPAA privacy rule in terms of the personal health information disclosure and administration.

Sharing of Non-Personal Information and Non-Personally-Identifiable Information: esvyda may share Non-Personal Information with third parties for any purpose. We also share information about our audience in aggregate or de-identified form. Nothing in this Privacy Policy is intended to restrict esvyda’s use of aggregated or de-identified information in any way.

What are your rights regarding your protected health information?

You have certain rights regarding protected health information that we maintain about you. 

Right to Access Your Protected Health Information: You have the right to review or obtain copies of your protected health information records, with some limited exceptions. Usually the records include enrollment, billing, claims payment and case or medical management records. Your request to review and/or obtain a copy of your protected health information records must be made in writing. We may charge a fee for the costs of producing, copying and mailing your requested information, but we will tell you the cost in advance.

Right to Amend Your Protected Health Information: If you feel that protected health information maintained by us is incorrect or incomplete, you may request that we amend the information. Your request must be made in writing and must include the reason you are seeking a change. We may deny your request if, for example, you ask us to amend information that was not created by us, as is often the case for health information in our records, or you ask to amend a record that is already accurate and complete.

If we deny your request to amend, we will notify you in writing. You then have the right to submit to us a written statement of disagreement with our decision and we have the right to rebut that statement.

Right to an Accounting of Disclosures: You have the right to request an accounting of disclosures we have made of your protected health information. The list will not include our disclosures related to your treatment, our payment or health care operations, or disclosures made to you or with your authorization. The list may also exclude certain other disclosures, such as for national security purposes.

Your request for an accounting of disclosures must be made in writing and must state a time period for which you want an accounting. This time period may not be longer than six years. Your request should indicate in what form you want the list (for example, on paper or electronically). The first accounting that you request within a 12-month period will be free. Right to Receive Confidential Communications: You have the right to request that we use a certain method to communicate with you or that we send information about you to a certain location if the communication could endanger you. Your request to receive confidential communications must be made in writing. Your request must clearly state that all or part of the communication from us could endanger you. We will accommodate all reasonable requests. Your request must specify how or where you wish to be contacted.

How is your information protected?

esvyda takes commercially reasonable precautions – including administrative, technical, and physical measures — to safeguard your Personal Information against loss, theft, and misuse, as well as against unauthorized access, disclosure, alteration, and destruction. 

There are several places on the esvyda site where you can transmit credit card information in order to complete a purchase transaction or for verification purposes. Anytime we ask for a credit card number we transmit that number in an encrypted format, for instance, using SSL (secure socket layer) encryption. Also your “body metrics data” is transmitted in an encrypted format, for instance, using SSL (secure socket layer) encryption or other technology available.

Please note that no method of transmission over the Internet, or method of electronic storage, is 100% secure.


How do we edit, update, correct and/or delete information about you?

If you no longer wish to receive email communications from us simply click unsubscribe and we will add you to our “do not contact” list. Pursuant to the terms of this Privacy Policy, you cannot opt out of receiving certain email notices regarding your account.

We control and operate this website from our offices in the united states. Any information you provide to esvyda through this website is stored and processed on esvyda servers in the united states or on those of our third party service providers. We do not represent that materials on this website are appropriate or available for use in other locations. Persons who choose to access this website from outside the united states do so on their own initiative, and are responsible for compliance with local laws, rules and regulations, if and to the extent applicable. 

What else should you know about your online privacy?

Please keep in mind that whenever you voluntarily disclose personal information online – for example on message boards, through e-mail, or in chat areas – that information can be collected and used by others. In short, if you post personal information online that is accessible to the public, you may receive unsolicited messages from other parties in return.

Children’s Guidelines and COPPA Compliance: This website is not intended to collect or maintain Personal Information from persons under 13 years old. esvyda does not knowingly collect or store any Personal Information about children under the age of 13. Will I be notified of changes to your privacy practices?

We may amend this Privacy Policy from time to time. Use of information we collect is now subject to the Privacy Policy in effect at the time such information is used. If we make changes in the way we use Personal Information, we will notify you by posting an announcement through our Services or by sending you an email or other notification.
