What information is collected from you?
Enrolling in esvyda Services: If you choose to enroll in our service, esvyda asks for certain Personal Information, including but not limited to your name, address, e-mail, password, zip code, phone number, credit card number, mailing address, gender, age, weight, height, photograph, and government-issued identification number as well as certain health-related information such as your health care plan, delivery hospital, and doctor or midwife, well-being related information (including without limitation blood pressure, weight, SPO2, ECG, blood glucose monitor readings and other sensitive medical information), type of medical devices you use, browser information, daily routine, and medical history.
Once you enroll, you are no longer anonymous to esvyda. You are given a esvyda identification number and are able to take full advantage of esvyda offerings. When you enroll you will also be asked to set some security questions to access your account online, and you will be required to provide the answer for authentication purposes when you log in to your account, either using the web browser or the mobile app.
Information Requests: You may request information about clinical trials without enrolling. You will be asked to provide your name, address, email, phone number, and medical condition in which you are interested. You can also request information from esvyda; we may ask for your contact information and other information that will help us assist you. Some information is required while other information may be submitted at your option.
Special Events, Promotions, Surveys and Communications: In addition, we may collect your Personal Information at other times, including, but not limited to, when you answer a voluntary survey, when you enter a voluntary sweepstakes, contest or promotion sponsored by esvyda, and when you report a problem with one of our sites or services. If you contact esvyda, we may keep a record of that correspondence.
References: When you refer a friend or family member, esvyda may collect the information you provide about that person such as his name, mailing address, email address, and phone number.
esvyda also collects information that does not personally identify you when you access our services, visit our website, or use our mobile app. We may automatically receive and record information from your computer, mobile device, or other device you use to access our services, on our server logs. This information includes, but is not limited to, your IP address, cookie information, geolocation information, unique device identifiers, browser type, browser language, other transaction information, and the page you have requested (collectively referred to as “Site Usage Information”). Site Usage Information is aggregated to measure certain traffic patterns on our websites, such as the number of visits, average time spent on the website, pages viewed, and so on. If we do combine Non-Personal Information with Personal Information, the combined information will be treated as Personal Information as long as it remains combined.
When you receive emails from us, we may place a one-pixel gif in the email to determine whether or not readers viewed the email, if your computer or cellular phone supports this technology. This process does not leave any information on your computer, nor does it collect information from your computer or device. How is your information used?
Providing the Services You Request: We may use your Personal Information internally for our general business purposes, such as providing the services you request, responding to your inquiries, and offering you our own, our affiliates’ or third-party products and services that we think you may find of interest.
If you sign up to receive alerts to track your health, we will use the email address and/or mobile cell phone number you select/provide when signing up to track your medical devices for the sole purpose of providing you with tracking information about your medical devices or for sending medical alerts.
Improving and Developing our Services: We also use Personal Information to help us develop, deliver and improve our products, services, content, and advertising. We may also use Personal Information for internal purposes such as auditing, data analysis, and research to improve esvyda’s products, services, and customer communications.
Providing Notices: We may use your Personal Information to provide notices to you and to keep you updated on esvyda’s latest announcements and services. From time to time, we may need to use your Personal Information to send important notices, such as communications about your account. Because this information is important to your interaction with esvyda, you may not opt out of receiving these communications. Who is collecting your information?
With whom may your information be shared?
Healthcare providers: If you provide your healthcare provider’s information to us we may disclose personally identifiable information you have provided us to that provider, pursuant to the Health Insurance Portability and Accountability Act (“HIPAA”) privacy rules.
Service providers: We may disclose Personal Information about you to companies who provide services to esvyda, such as information processing, extending credit, delivering products to you, managing and enhancing customer data, , providing customer service, processing orders, fulfilling orders and requests, and conducting customer research. Your Personal Information will not be shared with third parties for their marketing purposes. We provide these companies only with the information they need to perform their services for esvyda and unless we tell you differently, these companies do not have any right to use the Personal Information we share with them beyond what is necessary to perform their services for us.
Others: We may disclose personally identifiable information about you if you request or authorize it. In addition, it may be necessary under law, legal process, litigation, and/or requests from public and governmental authorities, for esvyda to disclose your Personal Information. With Your Consent: Except as set forth above, you will be notified when your Personal Information or your Personal Health Information may be shared with third parties, and you will be able to prevent the sharing of this information.
We are limited by the HIPAA privacy rule in terms of the personal health information disclosure and administration.
What are your rights regarding your protected health information?
You have certain rights regarding protected health information that we maintain about you.
Right to Access Your Protected Health Information: You have the right to review or obtain copies of your protected health information records, with some limited exceptions. Usually the records include enrollment, billing, claims payment and case or medical management records. Your request to review and/or obtain a copy of your protected health information records must be made in writing. We may charge a fee for the costs of producing, copying and mailing your requested information, but we will tell you the cost in advance.
Right to Amend Your Protected Health Information: If you feel that protected health information maintained by us is incorrect or incomplete, you may request that we amend the information. Your request must be made in writing and must include the reason you are seeking a change. We may deny your request if, for example, you ask us to amend information that was not created by us, as is often the case for health information in our records, or you ask to amend a record that is already accurate and complete.

There are several places on the esvyda site where you can transmit credit card information in order to complete a purchase transaction or for verification purposes. Anytime we ask for a credit card number we transmit that number in an encrypted format, for instance, using SSL (secure socket layer) encryption. Also your “body metrics data” is transmitted in an encrypted format, for instance, using SSL (secure socket layer) encryption or other technology available.
Please note that no method of transmission over the Internet, or method of electronic storage, is 100% secure.
IT IS ALSO IMPORTANT FOR YOU TO HELP PROTECT AGAINST UNAUTHORIZED ACCESS TO YOUR INFORMATION. YOU ARE SOLELY RESPONSIBLE FOR SIGNING OFF OF OUR WEBSITE EACH TIME YOU FINISH USING IT AND FOR SECURING YOUR LOG-IN INFORMATION AND SECURITY RESPONSES. How do web-based communications differ if you are located outside of the united states?
We control and operate this website from our offices in the united states. Any information you provide to esvyda through this website is stored and processed on esvyda servers in the united states or on those of our third party service providers. We do not represent that materials on this website are appropriate or available for use in other locations. Persons who choose to access this website from outside the united states do so on their own initiative, and are responsible for compliance with local laws, rules and regulations, if and to the extent applicable.
What else should you know about your online privacy?
Please keep in mind that whenever you voluntarily disclose personal information online – for example on message boards, through e-mail, or in chat areas – that information can be collected and used by others. In short, if you post personal information online that is accessible to the public, you may receive unsolicited messages from other parties in return.

Because esvyda provides its California users with the ability to exercise “opt out” rights as described above, pursuant to Section 1798.83(c)(2) of the California Civil Code, esvyda is in compliance with California “Shine the Light” law and is not obligated to provide California users with the names and addresses of all the third parties that received personal information from esvyda for the third parties’ direct marketing purposes during the preceding calendar year.
